RESTORATION OF VIOLATED RIGHTS

Respect and honor towards the participants of war were the indispensable part of the human approach in all epochs of the history. Yet, at present, these values are not duly conceived among us. The story of the legal assistance that the Armenian Young lawyers Association provided to Andranik Gasparyan, 88 years old participant of the Great Patriotic War, is an evidence for this. In 2005 A. Gasparyan applied to the court with complain against the inactivity of the Republic of Armenia Military Commissariat requesting the court to oblige the Military Commissariat of the RA to recognize him as participant of the Great Patriotic War and realize all the necessary readjustment of his pension. On 23 May 2005 court of the First Instance of Kentron and Nork-Marash Communities and after that on 25 October 2005 the Court of Appeals on Civil Cases of the Republic of Armenia rejected A Gasparyan's application.
Realizing that he cannot protect his violated rights personally, A Gasparyan applied for the help of the Armenian Young Lawyers Association in early November 2005.On 16 December 2005 based on the appeal issued by Liana Harutyunyan, advocate of the Armenian Young Lawyers Association the Chamber of Civil and Economic Cases of the Court of Cassation vacated the decision of 25 October 2005 of the Court of Appeals on Civil Cases of the Republic of Armenia and send it back to consideration by the same court in other composition. Further, on 1 March 2006 the Court of Appeals on Civil Cases of the Republic of Armenia considered the civil case "Andranik Gasparyan v. the Republic of Armenia Military Commissariat" pleading the inactivity of the state body, decided to sustain the claim, to recognize A. Gasparyan participant of the Great Patriotic War, and realize all the necessary readjustment of his pension since 2000. This decision was not disputed and entered into legal force on 16 March 2006. At present A. Gasparyan with the support of AYLA has to apply to the Bodies for compulsory realization of the judicial acts, because the Republic of Armenia Military Commissariat fails to realize its obligations voluntarily. We are confident that Andranik Gasparyan will receive his certificate of Honorable Participant of the Great Patriotic War in the course of realization of the decision.
