Court Sitting on the Claim “Ararat “Housing and Public Utility Services” LLC versus the Citizens of Ararat City” took place
Court Sitting on the Claim to impose a penalty on cost recovery “Ararat “Housing and Public Utility Services” LLC versus the Citizens of Ararat City S.Sukiasyan, G.Karapetyan, A.Sargsyan, B.Hakobyan, L.Hovhannisyan” took place in the Court of General Jurisdiction of Ararat and Vayots Dzor Marzes on 12 April 2010. The Preliminary Court Sitting on the cases of A.Sargsyan and B.Hakobyan, of 12.03.2010 was delayed on solicitation to collect evidences. The court trial on the other three cases has been accomplished and the day for passing the verdict is set.
During the court session advocate A.Grigoryan, the representative of respondents, introduced arguments claiming to recognize the claims of the applicant invalid, and made statements referring to the evidences provided by the applicant.
It is due to mention that the “Ararat Housing and Public Utility Services” LLC (“Ararat HPUS” LLC) has filed a claim against some citizens of Ararat city demanding to pay for the services provided in the period of 1999 through 2007.
However the citizens refused to pay, claiming that the applicant is not a qualified plaintiff in this case and has no authority to introduce claims, on the assumption of the fact that he does not have the authority of collecting mandatory payments established for the owners of the apartment building structure, whereas the respondents as the owner of the apartment building # 6 of Ararat city has not any obligations to perform mandatory payments to Ararat HPUS” LLC.
The obligation of the owner of apartment building structure to perform mandatory payments is provided in Article 15 of the Law of the Republic of Armenia on Apartment Building Management. However the owners of the apartment building structure are liable to the Governing Body of the Building and not to Ararat HPUS” LLC.
